These Terms of Use (“Terms”) govern access to and use of the MyZen mobile application, website, and related services (collectively, the “Platform”), operated by MYZEN (Sole Proprietorship) (“MyZen”, “MYZEN”, “Company”, “we”, “our”, or “us”).
By accessing, registering on, or using the Platform in any manner, you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
1. Nature of the Platform
MyZen is a technology platform and intermediary only.
MyZen provides a platform that offers access to digital wellness content, fitness-related programs, and third-party service providers. MyZen does not provide medical advice, clinical diagnosis, therapeutic treatment, nutritional prescriptions, or personalized healthcare services.
MyZen does not guarantee any specific outcomes, results, safety, accuracy, or effectiveness arising from the use of the Platform, digital content, or services. Any statements, representations, recommendations, or claims made by third-party service providers, fitness centres, trainers, or content creators on the Platform are their own and do not constitute endorsements or guarantees by MyZen.
You acknowledge and agree that participation in fitness, wellness, exercise, meditation, or lifestyle activities involves inherent risks, and you voluntarily assume full responsibility for any risks, injuries, or consequences arising from your use of the Platform.
To the fullest extent permitted by applicable law, MyZen shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to personal injury, health complications, loss of data, loss of profits, or emotional distress, arising out of or related to your use of the Platform, content, or services, whether provided by MyZen or third-party service providers.
We facilitate access to:
- Digital wellness content
- Fitness, yoga, recipes, music, meditation, swar-vigyan, colour therapy, mudras, and lifestyle information
- Third-party fitness centres, trainers, coaches, and other service providers
- Subscription-based and free digital services
All services are provided at your own discretion and risk.
2. User Eligibility
- You are 18 years or older
- You are legally competent to enter into a binding contract under Indian law
- You are not barred from accessing the Platform under any applicable law
3. User Due Diligence & Responsibility
You expressly agree that you will conduct your own due diligence before:
- Following any fitness, workout, yoga, meditation, or other content available on the Platform
- Subscribing to or visiting any listed fitness centre or partner
- Acting on any information on the Platform
You will consult qualified professionals where necessary.
In no event shall MyZen’s total liability, if any, exceed the amount paid by you to MyZen in the six (6) months preceding the claim.
4. No Medical or Professional Advice
Nothing on MyZen constitutes medical advice, diagnosis, treatment, prescription, mental health counselling, or professional fitness or nutritional advice. All content is informational and educational only.
5. Assumption of Risk
You understand and agree that activities involve inherent risks. Injuries, discomfort, aggravation of existing conditions, or unforeseen complications may occur. You voluntarily assume all risks, known and unknown.
6. Third-Party Partners & Fitness Centres
Third parties listed or accessible through the Platform operate independently. MyZen does not control or guarantee their services.
7. Digital Content Disclaimer
Digital content may be pre-recorded, live, automated, or generated by third-party contributors. All such content is provided on an “as is” and “as available” basis. MyZen does not guarantee accuracy, completeness, outcomes, results, safety, or suitability for any individual.
8. Payments, Subscriptions & Refunds
Payments for services or subscriptions on the Platform are processed through independent third-party payment gateways and financial institutions. MyZen does not control users’ card, banking, or wallet details and shall not be responsible for payment failures, delays, duplications, unauthorized transactions, bank errors, chargebacks, or gateway-related issues arising from such third-party services.
Refunds are governed by the Refund & Cancellation Policy.
9. Limitation of Liability
To the maximum extent permitted under applicable law, MyZen shall not be liable for losses or damages arising out of or relating to your access to, use of, or inability to use the Platform, content, or services.
10. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Courts of Delhi, India shall have exclusive jurisdiction.
